Environmental Regulatory Requirements

No doubt navigating the regulations with Threatened & Endangered Species as well as other wildlife regulations can be a daunting task for the private landowner. We understand that and can explain to you in simple terms what your needs will be. If your project is involved in any way with a Federal agency, including needing Federal permits or licenses, or receives any type of Federal funding or approval, it is required to consult with the U.S. Fish & Wildlife Service (considered a Section 7 consultation) regarding Threatened and Endangered Species (TES). Beyond projects with a Federal nexus, even on private land any actions that could impact a TES species directly or to the species habitat can lead to a violation of the Endangered Species Act. Almost 8,000 violation cases were investigated in 2006 (most recent year with published data). Beyond T&E Species fines from $5,000 to 200,000 can be assessed for violations of the Eagle Protection Act and the Migratory Bird Treaty Act. There were a total of $28,218,944 in fines during the three-year period of 2004 – 2006 for violation of Federal wildlife laws.  Organizations can be fined up to $200,000 for a violation of the Endangered Species Act, Eagle Protection Act or Migratory Bird Treaty Act.
